Transmission leak

I have a transmission leak, I bought the car supposedly with an overhaul transmission. My friend however, spotted a leak where the transmission meet the drive axle. A few mechanics tell me its a seal that needs to be replaced. what does it take to replace the seal and to stop the leak? He garranteed an axle he replaced but he did not feel to warranty the transmission. He wants me to drop the vehicle off, and to look at the car, while I'm not around, and check the problem to find whether he will do the repair at no cost or not! How would you feel about this situation? How much would it cost to rebiuld or overhaul a transmission? I really do need advise!
